Role Summary:

The Legal Officer – Procurement Matters contributes to ensuring the effective use of Global Fund financing through the provision of professional expertise and support to the Sourcing Department on various legal aspects of procurement and contracting, as well as to other internal clients that require procurement-related legal support.  Embedded in the Legal and Compliance Department, the Legal Officer – Procurement works under the guidance and supervision of the Legal Officer - Procurement Lead, in coordination with the various units of the Sourcing Department, to ensure consistent application of the Global Fund’s policies, rules, regulations and procedures on all procurement-related matters, considering as well internationally accepted practices in the development community. 
The Legal Officer – Procurement Matters also supports the analysis of procurement-related agreements that will need the clearance of the Legal Officer - Procurement Lead.  S/he will also be providing advice to adequately identify, mitigate and/or manage legal, reputational and operational risks to the Global Fund. 
The Legal Officer – Procurement Matters will support the Legal Officer - Procurement Lead in institutionalizing and managing the procurement practice in the Legal and Compliance Department, through such efforts as mentoring and guiding other Legal Officers assigned with procurement-related tasks and responsibilities, developing guides and knowledge products, and implementing a capacity development program within the Legal and Compliance Department or, on a broader scale, within the Global Fund.

Responsibilities:

The main responsibilities of the Legal Officer – Procurement Matters include:
Policy, Institutional and Organizational Matters
  • Support the Legal Officer - Procurement Lead in establishing and maintaining an efficient and effective organizational structure within the Legal and Compliance Department, with standard operating procedures, to ensure that: (i) a specialized practice is established and maintained within the department; (ii) service delivery standards in terms of quality and efficiency are ensured and maintained; (iii) procurement-related opinions and services rendered by the department are consistent.
  • Effectively engage in the development of procurement-related policies, rules, regulations, procedures and templates within the Global Fund.
  • Keep abreast with procurement-related internationally accepted practices and trends in the development community, and consider how these may be adapted to the Global Fund’s unique operating environment.
  • Identify legal, reputational and organizational risks related to procurement and propose measures to mitigate or manage such risks for the efficient and effective delivery of the Global Fund’s programs.
Operational Matters
  • Provide legal analysis on procurement-related agreements that require the legal clearance of the Legal Officer - Procurement Lead or the Head, Legal and Compliance Department, as the case may be.
  • Draft and review procurement-related documents, such as framework agreements, contracts and tender documents.
  • Take a lead or support role (depending on the nature of the procurement transaction) in contract negotiations with Global Fund partners, suppliers, contractors and consultants.
  • Issue legal opinions on procurement-related matters, queries or issues.
Capacity Development
  • Support the Legal Procurement Lead in developing and implementing a legal procurement capacity development program within the Legal and Compliance Department or on a broader scale within the Global Fund.
  • Support the Legal Officer - Procurement Lead in developing guides and/or checklists that may be used by Legal Officers in the performance of procurement-related functions, as well as knowledge products.
  • Support the Legal Procurement Lead in managing the distribution of procurement-related tasks and responsibilities within the Legal and Compliance Department, and review outputs to ensure quality and consistency.
  • Mentor other Legal Officers who are assigned with procurement-related tasks and responsibilities.

Qualifications:

Essential:
  • University degree in law.

Experience:

Essential:
  • Minimum of 8 years professional experience working on legal, contacting and procurement matters at an international level, with preference for field experience in developing countries and/or development partners.
  • At least 4 years of direct experience on procurement.
  • Knowledge of legal procurement systems.
  • Experience in drafting procurement-related documents.
  • Experience in reviewing procurement agreements at the country, regional and international levels.
Desirable:
  • Experience in developing policies, guides and knowledge products.
  • Experience in developing and running capacity development programs.
  • Experience in handling high-value, complex or high risk procurement contracts.
  • Some experience in both demand and supply side activities in the health sector, and in particular related to AIDS, tuberculosis and malaria.

Competencies:

Languages:
An excellent knowledge of English and preferably a good working knowledge of French or one of the following: Arabic, Chinese, Russian, and Spanish.  Knowledge of other languages would be an asset.
